Terms and Conditions

Effective from 1st January 2024

Clause 1: Purpose

The terms and conditions of sale set out below detail the rights and obligations of LIGNE 13 and its customers in relation to the sale of the following goods: Bags and various accessories made from offcuts of denim and fabric.
Any service provided by LIGNE 13 therefore implies the purchaser’s unconditional acceptance of these general terms and conditions of sale.

Clause 2: Price

The prices of the goods sold are those in force on the date the order is placed. They are quoted in Tunisian dinars or euros and are exclusive of tax. Consequently, VAT and delivery charges applicable on the date of the order will be added to these prices.
LIGNE 13 reserves the right to change its prices at any time. However, it undertakes to invoice the goods ordered at the prices stated at the time the order was placed

Clause 3: Discounts and rebates

The prices quoted include any discounts and rebates that LIGNE 13 may grant, depending on its financial results or the buyer’s assumption of certain services.

Clause 4: Discount

No discount will be given for early payment.

Clause 5: Terms of payment

Payment for orders is made:

  • Either by cheque;
  • Or by credit card;
  • If applicable, in cash on the day of delivery.

Clause 6: Retention of title clause

LIGNE 13 retains ownership of the goods sold until full payment of the price, including the principal sum and any ancillary charges, has been received. Accordingly, should the buyer become subject to administration or compulsory liquidation, LIGNE 13 reserves the right to claim, within the framework of the insolvency proceedings, the goods sold that remain unpaid.

Clause 7: Delivery

Delivery is made:

  • Either by delivering the goods directly to the buyer;
  • Either by sending a notice to the buyer that the item is ready for collection in store;
  • Or to the address specified by the purchaser on the order form.

The delivery time stated when the order is placed is for guidance only and is in no way guaranteed.

Consequently, any reasonable delay in the delivery of the products shall not entitle the purchaser to:

  • The award of damages;
  • Cancellation of the order.

The risk associated with transport is borne entirely by the buyer.
In the event of goods being missing or damaged during transit, the purchaser must note all necessary reservations on the delivery note upon receipt of the goods. These reservations must also be confirmed in writing within five days of delivery, by registered post with acknowledgement of receipt.

Clause 8: Force majeure

LIGNE 13 shall not be held liable if the non-performance or delay in the performance of any of its obligations set out in these general terms and conditions of sale is due to a force majeure event. In this context, force majeure refers to any external, unforeseeable and unavoidable event.

Clause 9: Jurisdiction

Any dispute relating to the interpretation and performance of these general terms and conditions of sale shall be governed by Tunisian law.

If no amicable settlement can be reached, the dispute will be brought before the Commercial Court of Tunis.
